Abstract

Since the 1970s, significant social, legal, and scientific changes in the criminal justice system and the forensic sciences have altered the silhouettes of the law-science interface. The forensic sciences have made dramatic scientific advances in criminal case processing. The legal system and forensic science aim to produce knowledge and find facts as the foundation for justice with the solitary purpose of assisting the court in its evidential task. Thus, it leads to the solicitation of knowledge and methodology of various disciplines of science to legal matters. The growing implication of science in crime investigation for inquiring, collection, preservation, and analysis of evidence for prosecuting an offender in the court has concreted an easier path for administering justice. The paper reviews the role of physical evidence in investigation process and criminal profiling and offers suggestions as to where we need to focus our efforts. Thus, the aim is to define a scientific and legal framework for effective administration of criminal justice system in India.


Description

Forensic science infers rule of law and enhances the criminal justice system. By using evidence, one can investigate who committed a crime and how it was committed. Judges and juries put great stock in this type of forensic testimony, and when presented at trial, such evidence can make the difference between conviction and acquittal. Criminal investigations are performed through technical succour to decide on whether a crime has been committed, when, how and by whom. The rights of defendant are also safeguarded by forensic services by means of exonerating the innocent and corroborating a victim’s evidence. Over the years, forensic science has made distinctive progress. Therefore, with the advent of technology, there has been a radical advancement of criminal justice.
